Ketanji Jackson is more MAGA than Barrett
In Fischer v. United States (decided June 28, 2024), the Supreme Court ruled 6-3 that 18 U.S.C. § 1512(c)(2)—the obstruction statute used in hundreds of January 6 cases—only applies to acts that impair the availability or integrity of evidence (such as records, documents, or objects) in an official proceeding, not to all forms of obstructive conduct. The Court held that the Justice Department had overinterpreted the law, which was originally enacted post-Enron to address document destruction.
The majority opinion was written by Chief Justice John Roberts and joined by Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh, and Ketanji Brown Jackson. Justice Amy Coney Barrett authored the dissent, joined by Justices Sonia Sotomayor and Elena Kagan, arguing the majority improperly narrowed the statute’s clear text. Justice Jackson also filed a concurrence, noting the ruling still allows prosecutions if defendants impaired evidence like electoral vote records.
The decision potentially affects over 350 January 6 defendants charged under this provision, requiring lower courts to reassess whether specific actions involved evidence tampering.
